2003年环境资源法学国际研讨会论文集 The Proceedings of International Conference on Environment and Resources Law 前 言 为促进我国的环境资源法制建设和环境资源法学研究，加强环境资源法学的国际和国内交流与合作，教育部人文社会科学重点研究基地武汉大学环境法研究所于2003年10月24~26日在武汉举行“2003年环境资源法学国际研讨会”（INTERNATIONAL CONFERENCE ON ENVIRONMENT AND RESOURCES LAW IN 2003）。本次会议特别邀请国内外高等院校、研究机构、政府部门专门从事环境资源法学研究的学者和环境资源法制工作的专家参加。 会议的主题是环境资源法学前沿问题研究。研讨的主要问题包括：1．比较环境资源法学、中国环境资源法学、外国环境资源法学、国际环境资源法学理论研究；2．企业环境法律问题的比较法研究；3．加入WTO后中国环境法律问题研究；4．国内外环境纠纷解决及典型案例研究 等。 本次会议得到教育部、国家环境保护总局、武汉大学和武汉大学法学院等单位的指导、关心。会议由教育部人文社会科学重点研究基地基金和武汉大学资助，并得到美国胡知宇律师事务所资金赞助，武汉大学及其法学院等单位提供了会务工作支持和其他帮助。特致谢意！ 本次会议秘书组将会前征集论文50多篇，汇编成册，供大会交流。部分论文经作者同意将通过《中国环境法网》上网交流（网址www.riel.whu.edu.cn）。谨向全体作者致以谢忱。 教育部人文社会科学重点研究基地 武汉大学环境法研究所 2003年10月15日 Preface The Research Institute of Environmental Law (RIEL) in Wuhan University ranks as one of the KEY RESEARCH INSTITUTES OF HUMANITIES AND SOCIAL SCIENCES IN UNIVERSITIES in China. It is also the unique research institute on environmental law under the State Environmental Protection Agency (SEPA) of China. In order to develop the domestic and international cooperation on the researches on environmental protection and legislation, RIEL decides to organize the “INTERNATIONAL CONFERENCE ON ENVIRONMENT AND RESOURCES LAW IN 2003” during 24-26 October 2003 in Wuhan City, Hubei Province, China. Nearly 100 Experts and scholars in environmental law from home and abroad have been invited to participate in the Conference. The topic of the Conference focuses on the theoretical research on environmental law, the international environmental law, WTO and environmental law, the implementation of environmental laws & regulations, environmental disputes, environment lawsuits, case studies and so on. The Conference received concern and aid from Ministry of Education, State Environmental Protection Administration (SEPA) and Wuhan University. The Conference is supported by the MOE Project of Key Research Institute of Humanities and Social Sciences in Universities and Wuhan University. The Law Offices of Zhiyu Hu (USA) also provided sponsorship for the Conference. The Proceedings of the Conference include over 50 papers, some of which will be put on the website www.riel.whu.edu.cn after the authorization from the authors.
