Prof. Marjan Peeters has given lectures in RIEL on the theme of “the adjustment mechanism of environmental law”
On the afternoon of March 27, 2017, the forty-fifth lecture of the Luojia Environmental Law Forum was held at the 325 classroom of the law school. Prof. Marjan Peeters from the University of Maastricht, the Netherlands, lectured on the theme of "Environmental Law Adjustment Mechanism". Prof. Ben Boer, Prof. Alexander Zahar, Dr. Wu Yu and all of the Ph.D. and postgraduate students attended. The lecture was presided by Liu Jing, Associate Professor of RIEL.
At the beginning of the lecture, Prof. Liu Jing gave a brief introduction to Professor Peeter. Then, Professor Peeters start her lecture combining with PPT.
Professor Peeters has first raised the question: "As we all know, the adjustment mechanism is necessary in the environmental legal system, but how should we design this mechanism?" She believes that legislators generally have three mechanisms to choose from: command and control, market-based and information-based adjustment.
Professor Peeters has argued that the effectiveness, efficiency, and its distribution value, fair value, and government value should be taken into account when evaluating the adjustment mechanism. Finally, Professor Peeters introduced the two pillars of EU environmental law as examples: industrial emissions and emissions trading systems.
Then, Professor Alexander put forward his own question: in changing the general public's environmental idea, will environmental law adjustment measures be more effective than other means? Professor Peeters has argued that people are often reluctant to be told by politicians how to behave, and are more willing to accept local environmental rules, and people do not like the market adjustment mechanism either because they think the market mechanism gives the polluting enterprises too much freedom.
The students also raised some questions which Professor Peeters answered respectively. Finally, Wu Yu expressed his own views on eco-label of information-based approach.
