刘明全教授做客讲坛，解析环境诉讼禁令制度

Prof. Liu Mingquan visits Luojia Lecture Series on Environmental Law

On November 7, 2016, the 39th Luojia Lecture Series on Environmental Law invited Assoc. Prof Liu, Mingquan from the Law school of Southeast University. His gave a lecture entitled “Environmental Litigation Injunction: Prevention and Precaution”

Prof. Liu Mingquan gave a detailed introduction of the environmental litigation injunction system in terms of concepts, forms, domestic disputes and basis of claims. Among them, he focused on explaining the constitutive elements of this system with a graphical way. When introducing the Japanese environmental law, he integrated the scholars’ proposal points of Japanese civil law amendment and analyzed the significance and enlightenment of a national landscape litigation judgment, which gave an intuitive understanding about the development and status of environmental litigation injunction in Japan.

In the comparison of preventive principle and precautionary principle, Prof. Liu, analyzed the premise, necessary condition and effect of the precautionary principle, and put forward his own views on the relationship between the environmental litigation injunction system and the public interest litigation. Finally, He proposed that, the relationship between the environmental litigation injunction system and the code, the applicable boundary of this system, and how to deal with the relationship between environmental justice and society, are worthy of further research and discussion.
